TERMS OF USE

These Terms of Use ("Terms") constitute a legally binding agreement between you and Mobile App Dev LLC (doing business as BOOTH) ("Company," "we," "us," or "our"), governing your access to and use of the BOOTH: Photo Booth mobile application and any related services (collectively, the "App").
BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE APP.

1. ELIGIBILITY
You must be at least 13 years of age to use the App. If you are under 18, you must have your parent's or legal guardian's permission. By using the App, you represent and warrant that you meet these requirements. We do not knowingly permit children under 13 to use the App. If we learn that a user is under 13, we will terminate their access immediately.
2. LICENSE TO USE THE APP
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device you own or control, solely for your personal, non-commercial use.
You may not:
- Copy, modify, or create derivative works of the App;
- Reverse engineer, decompile, or disassemble the App;
- Sell, sublicense, or redistribute the App or any part of it;
- Use the App for any unlawful purpose or in violation of these Terms.
3. IN-APP PURCHASES AND SUBSCRIPTIONS
BOOTH Pro is an optional paid subscription that unlocks premium features including watermark removal, HD exports, premium filters and colors, custom labels, and unlimited memories. The following subscription options are available:
BOOTH Pro Annual — $29.99 per year. Auto-renews annually.
BOOTH Pro Monthly — $4.99 per month. Auto-renews monthly.
Billing. Subscriptions are processed through Apple In-App Purchase. Payment is charged to your Apple ID account at confirmation of purchase. Subscription automatically renews unless canceled at least 24 hours before the end of the current period.
Managing Your Subscription. You can manage and cancel your subscription at any time through your Apple ID Account Settings. Cancellation takes effect at the end of the current billing period.
Refunds. All purchases are final and non-refundable except as required by applicable law or Apple's own refund policies. To request a refund, contact Apple directly via reportaproblem.apple.com.
Print Orders. The App may offer an optional Print & Ship feature fulfilled by Prodigi. Once a print order is placed, it cannot be canceled. All print orders are final.
4. USER CONTENT
The App allows you to capture photos and create photo strips ("User Content"). You retain all ownership rights in your User Content. By using the App, you grant us a limited, royalty-free license to process and store your User Content solely to provide the App's features to you.
You represent and warrant that: (a) you own or have the rights to all User Content; (b) your User Content does not violate any third-party rights or applicable laws; and (c) you will not use the App to capture or share content that is illegal, harmful, or violates the rights of others.
5. PROHIBITED CONDUCT
You agree not to use the App to:
- Violate any applicable law or regulation;
- Capture, create, or share content that is obscene, defamatory, or invades another person's privacy;
- Capture photos of individuals without their consent;
- Attempt to gain unauthorized access to any part of the App or our systems;
- Use automated means to access or interact with the App without our written consent.
6. INTELLECTUAL PROPERTY
The App, including its design, graphics, code, features, and branding, is owned by Mobile App Dev LLC and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership rights to you. The BOOTH name and logo are trademarks of Mobile App Dev LLC.
7. PRIVACY
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you agree to the collection and use of information as described in our Privacy Policy.
8. DISCLAIMERS
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.
9. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL MOBILE APP DEV LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRIOR TO THE CLAIM, OR (B) $50.00 USD.
10. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Mobile App Dev LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or connected with: (a) your use of the App; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.
11. TERMINATION
We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice. Upon termination, all licenses granted to you will immediately cease. Sections 6, 8, 9, 10, and 12 will survive any termination.
12. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of the State of Arizona, United States. Any dispute will be resolved through binding individual arbitration under the American Arbitration Association's Consumer Arbitration Rules. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTION LAWSUITS.
13. APPLE APP STORE TERMS
If you downloaded the App from the Apple App Store, you acknowledge that:
- These Terms are between you and Mobile App Dev LLC, not Apple. Apple has no obligation to provide maintenance or support for the App.
- Apple is not responsible for addressing any claims relating to the App, including product liability, consumer protection, or intellectual property claims.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
- You must comply with applicable third-party terms when using the App.
14. CHANGES TO THESE TERMS
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the App after changes constitutes your acceptance of the updated Terms.
